Dale Y p Y, id Trustees, of Sharon, Massachusetts for a Special Permit under Section 174-25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp and float on Ockway Bay on properties located in an R-3 zoning district at 10 and 12 Little Neck Lane (Map 105 III Parcel 3 and Map 105 Parcel 4) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, I a newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, it 2002, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 23, 2002, at which time the following members of the Zoning Board D of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III j and Robert G. Nelson. I �' The Mashpee Zoning Board of Appeals issues this Decision pursuant to the J provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of j Mashpee Zoning By-laws. Mr. David Sanicki of Cape & Islands Engineering resented the Petition and g g re p stated that a portion of the existing pier, ramp and float is built on a neighbor's property. I Plans call for the existing decking to be relocated onto the owner's property. The ramp and float would remain in the same place. The Building Commissioner confirmed that the subject property is in the Special Permit area. The Conservation Commission and the Shellfish Constable have approved the proj ect. No comments were received from abutters.
