Town of Mashpee <br /> sy <br /> 16 Great JVeck pad Xorth <br /> MASHPEE ZONING BOARD OF APPEALS ashpee,ATassachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Robert Manning SP-02-26 21 Elliot Road <br /> Map 118 Parcel 122 <br /> A Petition was filed on January 2, 2002 by Robert Manning of Foxboro, <br /> Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws-laws to <br /> allow for demolition of an existing structure and construction of a single-family home <br /> on property located in an R-3 zoning district at 21 Elliot Road(Map 118 Parcel 122) <br /> Mashpee, MA. Owner of record: Robert Wolf&Roger S. Wolf. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall onIN <br /> Wednesday, January 23, 2002, at which time the following members of the Zoning Board <br /> of Appeals wereresent and actin throughout: Edward M. Govom, James E. Regan III <br /> i <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision <br /> Pp on pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town wn of <br /> Mashpee Zoning By-laws. ! <br /> Mr. David Sanicki of Cape & Islands s En ineerin represented the Petition and <br /> stated that plans call for demolition of the existing structure and construction of a new <br /> home on the subject property. Building Commissioner Russell W. Wheeler confirmed <br /> that the subject property lies within the Popponesset Overly District. Mr. and Mrs. <br /> Manning also attended the meeting. <br /> II <br /> The Conservation Commission has approved the project. <br /> No comments were received from abutters. <br /> SPECIAL PERMIT CRITERIA <br /> § 174-20 of the Zoning By-laws states: <br /> "Rebuildingof destroyed or dam <br /> y aged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt subject to approval of the Board of Appeals subject to <br /> the same conditions as set forth in § 174-24 of this chapter". <br />
