Dougherty <br /> V-02-29 192 Ninigret Avenue I <br /> I "I <br /> Map 65 Parcel 94 <br /> A Petition was filed on December 28, 2001 by Dale A. and Deborah J. Dougherty <br /> of Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the front setback and lot coverage requirements to allow for alteration and expansion <br /> of a pre-existing, non-conforming structure with addition of a garage/boathouse on a pre- <br /> existing, non-conforming property located in an R-3 zoning district at 192 Ninigret <br /> Avenue (Map 65 parcel 94) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times a <br /> P � <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, I. <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, January 23, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson <br /> and Marshall A. Brem. <br /> it <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> I ' i II <br /> Attorney Kevin <br /> M. Kirr <br /> ane represented sented the Petitioner, Mr. and Mrs. Dougherty, I �' <br /> both of whom also attended the meeting. The Petitioner also filed a request for a Special j <br /> Permit under Section 174-17 of the Zoning By-laws to allow for alteration and expansion <br /> of a pre-existing, non-conforming structure with addition of a garage/boathouse on the <br /> pre-existing, non-conforming property located at 192 Ninigret Avenue, which request the j <br /> Zoning Board of Appeals voted unanimously to Deny Without Prejudice. <br /> After some discussion, Attorney Kirrane requested a Withdrawal Without <br /> Prejudice of the Petition for Variance relief: <br /> At the Public Hearings held on January 23, 2002,the Board voted unanimously to <br /> accept the request for <br /> Withdrawal Without Prejudice <br /> of the Petition for a Variance <br /> V-02-28. <br /> i <br />
