Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 8 and March 15, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 27, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Frederick R. Borgeson, Zella E. <br /> Elizenberry and Marshall A. Brem. ! I ISI VIII <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the ;III <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. H. Earl Lantery, Jr., Engineering IiConsultant, represented the Petition and i <br /> stated that plans call for construction of a new single-family home, which would be built <br /> further away from the pond than the existing dwelling. Although this project does not <br /> need Variance relief from the setback requirements, Variance relief is needed to allow for <br /> construction of the new home on an unpaved road.. The Petitioner is also requesting a j Ili l� <br /> Special Permit to allow for demolition of the existing dwelling on the subject property. li <br /> The proposal would include removal of the existing septic system and installation of a <br /> new denitrification system on the subject property. Proposed lot coverage would be 6%. <br /> Mr. Borgeson read a letter from Attorney John S. White on behalf of`property <br /> owners who have concerns regarding construction of Horseshoe Bend Way' and the <br /> damage done to the road by heavy machinery when a house is being constructed. The <br /> letter concluded with a request that `the builder be required to restore the road to usable <br /> condition'. Mr. Brem questioned if emergency apparatus would have trouble accessing <br /> the road. Mr. Borgeson said that he visited the subject property and that the road is <br /> difficult to navigate in certain areas. No other comments were received from abutters. <br /> II I � Ii <br />
