i <br /> Mashpee Zoning Town of Mashpee Harbormaster V-02-48 2 <br /> Board of Appeals 388 Mashpee Neck Road <br /> I e � <br /> GENERAL FINDINGS „ <br /> 1. that the subject property is located at 388 Mashpee Neck Road and fronts on <br /> Popponesset Bay. <br /> SPECIFIC FINDINGS �I <br /> The Board determined that: ;I <br /> L the Petitioner met the criteria for grant of a Special Permit. <br /> 2. the proposal has been approved by the Shellfish Constable, whose II Ill <br /> responsibilities include protection of the marine environment. �I�I <br /> iii I I' " <br /> 3. the proposal has been reviewed by the Conservation Commission, whose <br /> responsibilities include addressing impacts on the coastal environment. I; <br /> 4. the proposal has been submitted for approval by the Harbormaster, whose <br /> responsibilities include safety on the water. !I' <br /> 5. the use is in harmony with the general purpose and intent of the By-laws. I I' <br /> 6. the owner has rights to maintenance in perpetuity. <br /> 7. filing with the State DEP Wetlands Program shall be considered execution of <br /> the Special Permit. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted <br /> pp unanimously on March 27, 2002 I i� <br /> to grant a Variance of 26 feet to allow for the proposed construction on the subject <br /> property.
