Notice was given by publication in The Mashpee Enterprise, a it li j <br /> newspaper of general circulation in the Town of Mashpee, on April 5 and April 12, 2002, <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of 1 wil <br /> i III' <br /> Mashpee Zoning By-laws. ! <br /> The ZBA office received a fax on April 24, 2002 from Attorney Robert F. Mills �I <br /> on behalf of the Petitioner requesting a continuance to allow for comment from other <br /> Town Boards. At the Public Hearings on April 24, 2002, the Mashpee Zoning Board of ! <br /> Appeals voted unanimously to continue the Petition until May 22, 2002. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 22, 2002, at which time the following members of the Zoning Board of Ili <br /> I <br /> Appeals were present and acting throughout: Edward M. Govoni, Richard T. Guerrera <br /> and Zella E. Elizenberry. <br /> � i <br /> Messrs. Robert F. Mills and David Chapman represented the Petition. Attorney li l <br /> i <br /> Mills requested that the term `caretaker's quarters' be modified, since the proposed <br /> apartment would house an employee of the funeral home. Mr. Chapman verified that all <br /> five of his other funeral homes contain an apartment for an employee. He said that II <br /> P <br /> having an employee on call and living at the funeral home accommodates the needs of �I II <br /> the public. The Board asked why the apartment was not included on the original Special Ili <br /> Permit, SP-01-29. Mr. Chapman said that the architect was under the impression that ,l <br /> there would not be enough space for an apartment on the upper level of the building. ! <br /> However after consulting with a structural engineer, it was discovered that the building i <br /> could accommodate an apartment. <br /> i <br /> I� I I <br />
