Mr. <br /> Colby said that the proposed house would be similar in size and design other <br /> to the othI' <br /> II � <br /> homes that have recently been built in the neighborhood. Mr. Colby said that the j <br /> Petitioner wants to build a modest home on the subject property. <br /> Mr. Paul Morgenstern, an abutter at 189 Waterway, expressed distress that the Petitioner <br /> did not comply with the Boards request for submission of proposed house plans. He <br /> stated that `today at 3:00 in the afternoon' that(referring to the proposed house plans) <br /> was all he received. Mr. Morgenstern said that he conducted a survey of 19 homes in the <br /> area on Waterway, Bright's Cove, Bluff Avenue and Bosun's Lane and came up with <br /> figures of land area and net living area of the home on each lot. He said that his j <br /> calculations showed an average ratio of 13.2%between the land area and living area on i l <br /> each property. Mr. Morgenstern said that 13.2% of the 13,600 square-foot subject ! l <br /> property would translate into a living area of 1,755 square feet. Based on those figures, <br /> he said that the proposal is not a modest home and would be out of scale with other <br /> homes in the area. Mr. Morgenstern requested that the Board require the Petitioner to j <br /> I <br /> scale down the size of the proposed home on the property. Mr. Colby asked Mr. l! <br /> Morgenstern what he would consider to be a modest sized home for the subject property. <br /> Mr. Morgenstern repeated that a home of 1,700 square feet would be modest. !� <br /> Mr. Govoni expressed disappointment that the Board did not receive a plan as had been <br /> requested. Mr. Colby said that `we're here tonight' to `hopefully come to some <br /> agreement with the Board and the abutters'. <br /> Ms. Gabrielle Clemens, an abutter at 196 Waterway, said that she echoed the sentiments <br /> of Mr. Morgenstern. She said that Mr. Corda's plan does not show size, scale or any <br /> dimensions and she felt that the plan was not submitted in good faith. Mr. Govoni agreed <br /> with Ms. Clemens' comment. Mr. Corda said that he was not attempting to misrepresent �! <br /> anything and apologized for not completing the plans with dimensions. He said that the j <br /> plan was submitted for the purpose of providing `for aesthetic elevations and overviews' <br /> and was built inside `an envelope and pre-existing plan'. Mr. Corda said that a 3,000 <br /> square-foot home would be average for the property. <br /> Attorney Kevin M. Kirrane arrived at the meeting and asked for a continuance of the <br /> matter to allow him an opportunity to confer with this client. r; <br /> Mr. <br /> Govoni said that the Board has been lenient in trying to help people out. He said that � r <br /> the state law considers the lot line to have been eliminated between the two properties l' <br /> located at 184 and 190 Waterway and considers the properties as one buildable lot. Mr. I <br /> Bill Mallett asked if the abutters have a figure in mind as to the size of the house that they ! <br /> would agree to being built on the subject property. Mr. Govoni said that `technically and <br /> legally' a Variance granted by the Board in this matter would be overturned in court if it j <br /> 4 <br />
