Stone SP-02-53 156 Waterway r <br /> Map 105 Parcel 238 <br /> A Petition was filed on March 18, 2002 by Jason E. Stone of Mashpee, j <br /> Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws to <br /> allow for demolition of an existing dwelling and construction of a single-family home <br /> on property located in an R-3 zoning district at 156 Waterway (Map 105 Parcel 238) ! <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 5 and April 12, 2002, I. <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 24, 2002, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson and <br /> Frederick R. Borgeson. Mr. Brem stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael H. Grotzke of the Phoenix Group represented the Petitioner and <br /> stated that the subject property was created in 1961. Plans call for demolition of the �� ! <br /> existing dwelling and construction of a new single-family home on the subject property. <br /> The proposal would not exceed the lot coverage requirements. <br /> The Conservation Commission has approved the project. The Board of Health <br /> has approved the proposed installation of a new denitrification septic system. Ii <br /> No comments were received from abutters. <br /> j <br /> SPECIAL PERMIT CRITERIA �I <br /> § 174-20 of the Zoning By-laws states: �I <br /> "Rebuilding of destroyed or damaged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt, subject to approval of the Board of Appeals subject to <br /> the same conditions as set forth in § 174-24 of this chapter". <br /> C. <br /> I <br /> I <br />
