Stone of Mashpee, I <br /> Massachusetts for a Variance from Section 174-33 of the Zoning By-laws to <br /> vary the setback requirements to water and wetlands to allow for construction <br /> of a single-family home on property located in an R-3 zoning district at 156 <br /> Waterway (Map 105 Parcel 238) Mashpee, MA. 1 <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a i <br /> newspaper of general circulation in the Town of Mashpee, on April 5 and April 12, 2002, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 24, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson j I, <br /> and Frederick R. Borgeson. Mr. Brem stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the I li <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael H. Grotzke of the Phoenix Group represented the Petitioner and <br /> i!iil <br /> stated that the subject property was created in 1961. Plans call for demolition of the <br /> existing dwelling and construction of a new single-family home on the subject property. <br /> Because of the close proximity to wetlands, the Petitioner is seeking Variance relief from <br /> the setback requirements to water and wetlands to allow for construction of a new <br /> dwelling on the subject property. The proposal would not exceed the lot coverage <br /> requirements. f <br /> The Conservation Commission has approved the project. The Board of Health <br /> I <br /> has approved the proposed installation of a new denitrification septic system.
