Town o Mash ee <br /> 16 Great Xeck Pgad Xorth <br /> ����� MASHPEE ZONING BOARD OF APPEAL <br /> WE 02649 <br /> Decision for a Variance <br /> RE: Judith& Brian Miller V-02-86 2 Popponesset Island Road <br /> Map 105 Parcel 267 <br /> A Petition was filed on July 1, 2002 by Judith and Brian Miller of Waban, <br /> Massachusetts for a Variance from Section 174-25.1.9 of the Zoning By-laws for <br /> permission to exceed the 70-foot total length limit to allow for construction of a pier, <br /> ramp and float on Popponesset Bay on property located in an R-3 zoning district at 2 <br /> Popponesset Island Road (Map 105 Parcel 267) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General j <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 9 and August 16, <br /> 2002, a copy of which is attached hereto and made a part hereof. T <br /> i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on a. <br /> Wednesday, August 28, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan, III <br /> and Robert G. Nelson <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> I <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Johansen represented the Petitioner and stated that the Special Permit, <br /> �I <br /> which the Board granted in 2001 to allow for construction of the pier, ramp and float on <br /> the subject property, is still valid. However,the Variance has expired. No changes have <br /> been made to the original proposal. <br /> The Conservation Commission has approved the project. <br /> No comments were received from abutters. <br /> �,;, <br /> I <br /> I <br /> I�i <br />
