Owner of record: Mashpee Commons Limited Partnership. <br /> II II <br /> Notice was duly given to abutters in accordance with Massachusetts General I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 9 and August 16, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on �. <br /> Wednesday, August 28, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson <br /> and James E. Regan III. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of III <br /> Mashpee Zoning By-laws. <br /> Mr. John Renz, Vice President of Mashpee Commons Limited Partnership, <br /> represented the petitioner, Perfection Fence Company. The Petitioner is seeking i <br /> permission to erect fencing to allow for outdoor sales on the subject property. <br /> C <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 38 Nathan Ellis Highway and consists of j <br /> 36 acres of land. <br /> SPECIAL PERMIT CRITERIA <br /> §174-25.E.8 of the Zoning By-laws states: [ <br /> "Store for retail sale of merchandise such as, but not limited to, lumberyards and building <br /> supply yards, wherein merchandise is stored in the open, provided that all merchandise so r �' <br /> stored is screened from ground level view from any abutting street or abutting property at <br /> the property line where such materials are stored". <br /> I <br />
