Town of Mashpee
" MASHPEE ZONING BOARD OF APPEALS A
y. 16 great JYeck load Jorth
DIE Decision for a Variance Mashpee, Massachusetts 02649
B B
RE: James Kerrigan, Trustee, c/o Smith& Connolly 11 Lettie Lane C j+
Map 36 Parcel 47E h
V-02-116
A Petition was filed on September 3, 2002 by James Kerrigan, Trustee, c/o Smith
& Connolly, requesting a Variance from Sections 174-32, 174-31 and 174-25 of the
Zoning By-laws for a lot held contiguously with adjoining non-conforming lot to 9
a
construct a single family house located in an R-5 and C-2 zoning district at 11 Lettie
t
Lane (Map 36 Parcel 47E) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on November 1 and
November 8, 2002, a copy of which is attached hereto and made a part hereof.
Public Hearings were held on Wednesday, October 9, 2002 and Wednesday,
November 13, 2002, at the Mashpee Town Hall and the following members of the Zoning
Board of Appeals were present and acting throughout: Robert G. Nelson, Marshall Brem
and Frederick Borgeson.
Attorney Kevin Kirrane represented the Petitioner James Kerrigan in the above-
entitled matter. Mr. Kirrane has requested, on behalf of his client, to be allowed to
develop this lot for residential purposes. He argues that although half of this lot is zoned
for commercial use, it makes little sense to develop the other four parcels directly
abutting this property for residential use and vote to maintain the commercial usage for
'1
this lot. Mr. Nelson informs Mr. Kirrane that the Board of Appeals has no authority to
grant use Variances and moves to deny this Variance request.
