�: <br /> Mashpee Zoning <br /> Board of Appeals Frank McDonnell V-02-119 <br /> 2 <br /> A <br /> Comments from abutters and/or concerned parties consisted of a memo (attached hereto) <br /> from Mr. Thomas Fudala, Mashpee Town Planner stating his objections to granting this B <br /> variance. <br /> C <br /> D <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> r <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 18 Lettie Lane and consists of 18,750 square <br /> feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the unpaved road affects the topography of this lot and not the district in <br /> which it is located. <br /> 2. Fire Department apparatus and other emergency vehicles can safely access <br /> Goodspeed Meetinghouse Road; therefore, relief may be granted without <br /> derogating from the intent or purpose of the By-laws. <br /> 3. Goodspeed Meetinghouse Road is accessible to vehicular traffic and is typical <br /> of many unpaved roads in the Town of Mashpee. <br />
