Clarke Hill and Heather Hill —Request a Variance from Section 174-31 to vary the <br /> side setbacks and to reverse an Appeal of the Building Commissioner's stop work order <br /> on property located in an R-3 zoning district at 50 Popponesset Island Road (Map 106 <br /> Parcel 24) Mashpee, MA. <br /> Sitting: Robert Nelson, James Regan and Edward Govoni <br /> The Board was asked by the Petitioner the render a decision in the above matter. Several <br /> attempts at a compromise were made, however nothing was resolved. After much <br /> discussion and testimony on this matter at several hearings prior to this evening,the <br /> Board votes to allow both the modification of the Special Permit 98-01 and a Variance <br /> for 5 feet on the westerly side and to reverse the Appeal of the Building Commissioner's <br /> stop work order. The accessory structure must be attached and made into one structure <br /> due to the 20-foot distance required keeping in compliance with the current zoning. <br /> Criteria include not anymore detrimental to the neighborhood. 'I <br /> The Board votes to accept the minutes from November 13. All agree. So moved. <br /> a <br /> Some discussion ensues regarding the Rosenberg decision. <br /> Motion to adjourn the meeting is made.
