10'N Town of Mashpee <br /> 16 Great Xeck load Xorth <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Little Neck Realty Trust SP-00-15 44 Little Neck Lane <br /> Map 105 Block 13 <br /> A Petition was filed on December 1, 1999 by Little Neck Realty Trust of West <br /> Yarmouth, Massachusetts for a Special Permit under.Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on property located in an S-3 <br /> zoning district at 44 Little Neck Lane (Map 105 Block 13)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 24 and <br /> December 31, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 12, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G.Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. i <br /> Mr. David Sanicki of Cape & Islands Engineering represented the applicant who I <br /> is seeking permission to construct a pier, ramp and float on the subject property. The <br /> Conservation Commission and Shellfish have approved the project. The Board has <br /> granted a Variance from the setback requirements to the water and the wetlands to allow <br /> for construction of a single-family home on the subject property. <br /> No comments were received from abutters. <br />
