Staples of Hingham, <br /> Massachusetts for a Variance from Section 174-33 of the Zoning By-laws to vary the <br /> setback requirements from the water and wetlands to allow for the addition of a deck to <br /> an existing home on property located in an R-5 zoning district at 95 Horseshoe Bend <br /> Way(Map 40 Block 4)Mashpee, MA. , <br /> Notice was duly given to abutters in accordance with Massachusetts General �• <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 24 and <br /> December 31, 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 12, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> Robert G. Nelson and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> The Board received a letter dated January 3, 2000 from Mr. Staples requesting a <br /> continuance of his petition until January 26, 2000 to allow for the advertising for a <br /> request for a Special Permit to demolish the existing home. <br /> The Board voted unanimously to continue the Petition until January 26, 2000. <br /> At the continued hearings on January 26, 2000, Mr. Staples represented his <br /> applications and submitted photos of the existing house that was built in the 1940's. <br /> He stated that his original plan was to make additions to the existing structure. The <br /> engineering firm told Mr. Staples that the old posts that support the existing structure <br /> are decaying and would be insufficient to support any new construction. <br /> The Conservation Commission has approved the project. <br />
