Mashpee Zoning Willowbend Development Corporation V-00-45 to V-00-69 <br /> Board of Appeals <br /> Separate applications were filed for each lot, but for ease of administration, a <br /> combined hearing was held and this Decision addresses all of the above-referenced <br /> applications. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 21 and January 28, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 9, 2000, at which time the following members of the Zonin Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Jack McElhinny, Executive Vice President of Willowbend Development <br /> Corporation and Attorney Donna Bergamo represented the applicant. Mr. McElhinny <br /> stated that the lots have been developed as quickly as allowed under the Town's growth <br /> management program. <br /> The Board granted Variances for 35 lots in Shoestring Bay in August 1998 and <br /> granted extensions to those Variances in 1999. The extensions expired January 14, 2000. <br /> I <br /> Willowbend Development Corporation spent over$4 million in improving public <br /> water supply, roads, a sewer treatment plant and landscaping. There are currently ten <br /> homes under construction. Eight Building permits were pulled in 1998. <br /> i <br /> No comments were received from abutters. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and i <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS I�� <br /> I; <br /> 1. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the '1;1 <br /> By-laws. l ill <br /> I' <br />
