E denber <br /> Y Y Y g <br /> of Lancaster, Massachusetts for a Special Permit under Section 174-17 of the Zoning IIS <br /> By-laws for permission to expand a pre-existing,non-conforming dwelling on property <br /> located in an R-3 zoning district at 43 Kim Path(Map 117 Block 90)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 4 and February <br /> I <br /> 11, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> I I, <br /> Wednesday, February 23, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Frederick R. <br /> Borgeson and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicants. <br /> The proposal calls for the removal of the existing deck and construction of a 14x12-foot <br /> addition that would be four feet from the property line. Another proposed addition j <br /> of 11x17 feet would conform to the setback requirements. The existing garage would <br /> I � <br /> become part of the house and the four-bedroom home would be reduced to a j <br /> three-bedroom home. <br /> The Conservation Commission has approved the project. <br /> Mrs. Brian Kent an abutter, attended the meeting. The <br /> Kent and her son, g Y <br /> expressed concern with the proposal blocking view of the water from Mr. Kent's abutting <br /> lot. Mr. Slavinsky stated that the applicant is not proposing a second floor to the existing <br /> j <br /> one-floor dwelling. Mrs. Kent and her son had no objection to the project. No other <br /> comments were received from abutters. <br />
