Eydenberg I <br /> of Lancaster, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws j <br /> I i I <br /> for permission to vary the sideline setback requirements to allow for additions to an lil <br /> existing dwelling on property located in an R-3 zoning district at 43 Kim Path(Map 117 I' <br /> Block 90)Mashpee, MA. i. <br /> N y <br /> Notice was duly given to abutters in accordance with Massachusetts General I I: <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on February 4 and February <br /> 111 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 23, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, Frederick R. <br /> I , <br /> Borgeson and Richard T. Guerrera. <br /> I II i <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of i? <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicants. <br /> The proposal calls for the removal of the existing deck and construction of a 14x12-foot <br /> addition that would be four feet from the property line. Another proposed addition <br /> I it I 'II <br /> of 11x17 feet would conform to the setback requirements. The existing garage would <br /> become part of the house and the four-bedroom home would be reduced to a j <br /> three-bedroom home. <br /> The Conservation Commission has approved the project. <br /> Mrs. Kent and her son, Brian Kent, an abutter, attended the meeting. They 'I <br /> expressed concern with thero osal blocking view of the water from Mr. Kent's abutting Milli <br /> p P <br /> lot.
