Smith of <br /> Cotuit, Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning <br /> By-laws for permission to vary the front setback requirements and the setback <br /> requirements from the water and wetlands to allow for construction of a single-family <br /> dwelling on property located in an R-3 zoning district at 266 Monomoscoy Road <br /> (Map 120 Block 57B) Mashpee, MA. <br /> Ii <br /> I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 18 and <br /> February 25, 2000, a copy of which is attached hereto and made a part hereof. j <br /> i <br /> Jill <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> I ' <br /> Wednesday, March 8, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, Richard T. Guerrera, I <br /> Frederick R. Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. I <br /> Mr. Pesce represented the Petition and stated that the proposed location of the <br /> home would be as far upland and away from the salt marsh and resource area as possible. <br /> I Ili <br /> The Board of Health has approved the proposal. <br /> IIS <br /> Mr. Pesce requested a continuance of the Petition V-00-81 to allow the applicant <br /> an opportunity to receive Conservation Commission approval. The Board voted <br /> unanimously to continue the Petition until April 26, 2000. �I <br /> This Petition has been continued from Public Hearings held on March 8, April 26, <br /> I <br /> May 10 and June 14, 2000. <br /> I <br /> On August 9,2000, the Board received a request from the engineer on behalf of <br /> the Petitioner for another continuance.
