Schofield SP-00-97 <br /> Board of Appeals 2 <br /> GENERAL FINDINGS <br /> I. that the subject property is located at 378 Monomoscoy Road and consists of <br /> 37,500 square feet fronting on Great River. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.I.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute <br /> to the substantial disruption or degradation of the marine or coastal environment. <br /> SPECIFIC FINDINGS <br /> 'I <br /> 1. that the proposed dock will be an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. that the Board has granted a Variance to exceed the 70-foot pier length limit. <br /> 3. that the proposal has been <br /> approved <br /> b <br /> Ythe Harbormaster <br /> and the Shellfish <br /> Constable whose responsibilities include safety on the water and protection of <br /> the marine environment. <br /> 4. that the proposal has been reviewed by the Conservation Commission to <br /> address impacts on the coastal environment. <br /> 5. that the use is in harmony with the general purpose and intent of the By-laws. <br /> 6. that the owner has rights to maintenance in perpetuity. <br /> 7. that filing with the Corps of Engineers shall be considered execution of the <br /> Special Permit. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on April 12, <br /> 2000 to <br /> grant a Special Permit to allow for construction of a pier, ramp and float on Great � I <br /> River on property located at 378 Monomoscoy Road. The Special Permit is conditioned <br /> upon compliance with Braman Engineering Company, Ltd.plans entitled <br /> Plan of <br /> Proposed Pier Prepared for Mark Schofield, 378 Monomoscoy Road, Great River, <br /> Mashpee, MA., Plan No. E-583, Date: July 9, 1996, Revised: January 13, 2000, March <br /> 15,2000, March 29, 2000". <br /> i <br /> r <br />
