Vining et al, Trustee 73 James Circle & 69 James Circle <br /> V-00-100 Map 64 Block 41 &Map 64 Block 42 <br /> A Petition was filed on March 1, 2000 by Michael P. Vining of Stoneham, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front setback requirements to allow for construction of an addition and a <br /> garage to property located in an R-5 zoning district at 73 and 69 James Circle (Map 64 <br /> Blocks 41 and 42) Owner of record of 73 James Circle: James Circle Realty Trust. <br /> Owner of record of 69 James Circle: Michael P. and Patricia A. Vining. <br /> i <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 24 and March 31, <br /> 2000, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson and <br /> Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> g <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the applicant to <br /> whom the Board granted a Variance in 1998 on the subject properties. However, <br /> substantial construction(as determined by the Building Department)was not started prior <br /> to the one-year expiration date of the original Variance, V-98-142. Mr. Sanicki said that <br /> there has been no change in the engineering plans. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject properties are located at 73 and 69 James Circle and consist of ;.. <br /> a total of 19,870 square feet. <br /> ��x <br />
