Murad, Trustee, of Boston, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the sideline setback requirements to allow for construction of a pool cabana on <br /> property located in an R-3 zoning district at 19 Keel Way(Map 120 Block 138)Mashpee, <br /> MA. Owner of record: Keel Way Real Estate Trust. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 24 and March 31, <br /> 2000, a copy of which is attached hereto and made a part hereof <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson and <br /> Frederick R. Borg eson. <br /> 'I <br /> The Mashpee Zoning Board.of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Wayne Tavares represented the applicant and stated that the proposed pool <br /> cabana has been approved by the New Seabury Architectural Review Committee. At the <br /> Public Hearings on January 12, 2000,the Board granted Variances to allow for <br /> construction of a swimming pool,patio and fence on the property. The applicant is now <br /> requesting a Variance of nine feet from the side setback requirements to allow for <br /> installation of the cabana. The Conservation Commission has approved the proposal. <br /> Mr. Tavares stated that the direct abutter and the applicant have installed pools <br /> side by side on their respective lots and have agreed to erect a mutual fence between the <br /> two lots. <br /> No other comments were received from abutters. 6 S Rl 9Z M 00 <br /> r. <br />
