Benway of Mashpee, <br /> Massachusetts for a Variance from Sections 174-31, 174-32 and 174-33 of the Zoning <br /> By-laws for permission to vary the front setback requirements,the setback requirements <br /> to the water and wetlands and the fire protection requirements to allow for construction of <br /> a single-family home on an unpaved road on property located in an R-3 zoning district at <br /> 37 Monomoscoy West Road(Map 114 Block 11)Mashpee, MA. Owner of record: Mary <br /> R. Brown, Trustee/Minnie Trust. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a L <br /> newspaper of general circulation in the Town of Mashpee, on March 24 and March 31, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> i <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape &Islands Engineering represented the applicant and <br /> i <br /> requested a continuance of the Petition. The Board voted unanimously to continue the <br /> i <br /> hearing until May 10, 2000 to allow the applicant an opportunity to appear before the ` <br /> Conservation Commission. <br /> At the continued hearings on May 10, 2000, Mr. David Sanicki of Cape &Islands <br /> Engineering represented the applicant and stated that the small lotp resents a hardship to <br /> the Petitioner because it is impacted by wetlands. The lot has frontage on two roads- <br /> Overlook Road and Monomoscoy Road West. Proposed lot coverage would be 5%. <br /> r. <br /> r <br />
