Fraser of Mashpee, Massachusetts for a Special Permit under Section 174-17 of the Zoning By-laws for permission to expand a pre-existing,non-conforming dwelling on property located in an R-3 zoning district at 302 Monomoscoy Road(Map 120 Block 84)Mashpee, MA. Owner of record: John M. Fraser and James J. Fraser. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, a copy of which is attached hereto and made a part hereof r` A Public Hearing was held on the Petition at the Mashpee Town Hall on # Wednesday, April 26, 2000, at which time the following members of the Zoning Board of Appeals were present and acting throughout: The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Mr. John Slavinsky of Cape &Islands Engineering represented the applicant and stated that the Monomoscoy Road subdivision was adopted in 1912, making the existing dwelling a pre-existing, non-conforming structure. The Board has granted the applicant a Variance from the front and rear setback requirements. The existing cesspool would be replaced and improved by a new Title V septic system with a micro-fast treatment system. Proposed lot coverage would be 15%. The Conservation Commission has approved the proposal. No comments were received from abutters. f ii s'
