Fraser and James J. Fraser. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, 2000, <br /> a copy of which is attached hereto and made a part hereof r` <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on # <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicant and <br /> stated that the Monomoscoy Road subdivision was adopted in 1912, making the existing <br /> dwelling a pre-existing, non-conforming structure. The Board has granted the applicant a <br /> Variance from the front and rear setback requirements. <br /> The existing cesspool would be replaced and improved by a new Title V septic <br /> system with a micro-fast treatment system.
