Fee III SP-00-129 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> g � II <br /> non-conforming use. <br /> I �. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed construction does not conform to the lot coverage or setback <br /> requirements and the Board has granted a Variance of 4.7% from the lot <br /> coverage requirements and a Variance of 50 feet from the frontage <br /> requirements on Dean's Hollow Road. <br /> i <br /> 2. hat the proposed construction will be farther away from the wetlands than the 010 <br /> existing structure. <br /> 3. that there is adequate land area to provide sufficient parking. <br /> 4. while the proposed construction will increase the non-conforming nature of <br /> the structure,the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 5. that the immediate neighborhood consists of single-family homes of similar <br /> size. Many have been improved with additions or reconstruction. <br /> 6. that due to the unusual shape of the lot,there is no other location for the II <br /> construction. <br /> In view of the foregoing,the Mashpee Zoning Board of <br /> Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on June 28, 2000 <br /> to grant a Special Permit. The Special Permit is conditioned upon compliance with"Fee <br /> I <br /> Residence"Archi-Tech Associates, Inc. plan and Cape &Islands Engineering plan <br /> � I <br /> entitled"House Reconstruction& Septic Upgrade, Proposed Sewage Disposal System, <br /> Prepared for Frank J. Fee III, Hse. No. 11 Dean's Hollow Road,Mashpee—Mass., Plan <br /> No. S 110899, Date: Nov. 8, 1999, Revised 4-27-00". <br />
