Bell of <br /> Framingham, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the front setback requirement to allow for construction of a new <br /> single-family home on property located in an R-3 zoning district at 45 Popponesset Island !! <br /> Road(Map 106 Block 14) Mashpee, MA. <br /> I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 4 and August 11, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on ?'I� <br /> Wednesday, August 23, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III �! <br /> and Robert G.Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the Petition and <br /> stated that the proposed house would meet the front setback requirements. The proposed <br /> porch would encroach on the front setback requirements by only 6 feet. The Conservation <br /> Commission has approved the proposal. <br /> Mr. Jim Sandler, owner of 44 Popponesset Island Road, attended the meeting <br /> along with his parents who occupy the home. Mr. Sandler objected to the proposed porch <br /> encroaching on the 40-foot front setback requirement. <br /> Building Inspector Russell W. Wheeler stated that the front setback for the subject <br /> property is 30 feet and that a porch overhang is allowed. However,the proposal calls for <br /> installation of porch columns for which the Petitioner is seeking a Variance from the <br /> Board. Mr. Govoni confirmed that the subject lot was created in the 1950's,pre-dates the l <br /> Zoning By-laws and isprotected under grandfathering. <br /> Mr. Sandler reviewed the plans and discussed the proposal with his parents. After <br /> a few minutes, Mr. Sandler informed the Board that his parents no longer object to the <br /> proposal with clarification of the setback issue and grandfathering of the subject lot.
