" town of Mashpee
• 16 Great Xeck Poad Xorth
°LE MASHPEE ZONING BOARD OF APPEALS Mashpee, Massachusetts 02649 !
Decision for a Variance 111 ?
RE: Steven C. &Patricia M. Bell V-00-161 Map 106 Block 14
45 Popponesset Island Road
A Petition was filed on July 26, 2000 by Steven C. &Patricia M. Bell of
Framingham, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws
for permission to vary the front setback requirement to allow for construction of a new
single-family home on property located in an R-3 zoning district at 45 Popponesset Island !!
Road(Map 106 Block 14) Mashpee, MA.
I
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on August 4 and August 11,
2000, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on ?'I
Wednesday, August 23, 2000, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III !
and Robert G.Nelson.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Mr. John Slavinsky of Cape &Islands Engineering represented the Petition and
stated that the proposed house would meet the front setback requirements. The proposed
porch would encroach on the front setback requirements by only 6 feet. The Conservation
Commission has approved the proposal.
Mr. Jim Sandler, owner of 44 Popponesset Island Road, attended the meeting
along with his parents who occupy the home. Mr. Sandler objected to the proposed porch
encroaching on the 40-foot front setback requirement.
Building Inspector Russell W. Wheeler stated that the front setback for the subject
property is 30 feet and that a porch overhang is allowed. However, the proposal calls for
installation of porch columns for which the Petitioner is seeking a Variance from the
Board. Mr. Govoni confirmed that the subject lot was created in the 1950's,pre-dates the l
Zoning By-laws and isprotected under grandfathering.
Mr. Sandler reviewed the plans and discussed the proposal with his parents. After
a few minutes, Mr. Sandler informed the Board that his parents no longer object to the
proposal with clarification of the setback issue and grandfathering of the subject lot. No
other comments were received from abutters.
I
i I r:
