I ; Massachusetts for a Variance from Section 174-33 of the Zoning By-laws to vary the setback requirements to water and wetlands to allow for construction of an addition to an existing home on property located in an R-3 zoning district at 16 Fells Circle (Map 122 Block 215)Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 22 and September 29, 2000, a copy of which is attached hereto and made a part hereof. j A Public Hearing was held on the Petition at the Mashpee Town Hall on I' Wednesday, December 13, 2000, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert G. Nelson, Richard T. Guerrera and Zella E. Elizenberry. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. 1 I This Petition has been continued from the October 11 and November 8, 2000 I ( , 1 Public Hearings to allow the Petitioner an opportunity to receive Conservation Commission approval. At the continued hearings on December 13, 2000,the Zoning Board of Appeals j voted unanimously to Deny Without Prejudice the Petition,V-00-183, because of the i following reasons: 1. the Petitioner has not received Conservation Commission approval.
