Mashpee Zoning Minutes—November 22, 2000 12 <br /> Board of Appeals <br /> Attorney Leitner stated that in 1998 the Petitioner and a neighbor purchased a lot between <br /> the two lots, removed an existing structure, divided the lot between the two properties <br /> and eliminated a buildable lot on the wetlands. <br /> Ms. Frappier referred to the submitted plans and clarified the Variance relief being <br /> requested. She said that the existing portion of the structure that is closest to the top of <br /> the coastal bank is 22.8 feet. Proposed construction would be 28.4 feet away from the <br /> top of the coastal bank. The relief being sought would be a Variance of 31.6 feet to the <br /> top of the coastal bank. Lot coverage would be well under the 20% lot coverage. ISI�li,iin:, <br /> No comments were received from abutters. I <br /> Mr. Brem moved to grant the Special Permit to remove the existing dwelling, subject to <br /> 01�"iUlli <br /> findings 1, 3, 4, 5, 6 and plan with final revision date of 10/12/00. Mr. Nelson seconded. <br /> All agreed. II <br /> Mr.Nelson moved to grant a Variance of 31.6 feet to the top of the coastal bank, subject <br /> to criteria 1, 2, 3 and findings 1, 2, 3 and plan with final revision date of 10/12/00. All agreed. <br /> Donald Ellis—Requests a Variance from Section 174-47.B.4 of the Zoning By-laws to <br /> vary the frontage requirements to allow for construction of a single-family home in a <br /> cluster subdivision on property located in an R-5 zoning district at 78 Deerfield Road <br /> (Map 3 Block 27) Mashpee, MA. <br /> Sitting: James E. Regan III, Robert G. Nelson, Zella E. Elizenberry, Frederick R. <br /> Borgeson, Marshall A. Brem. <br /> The Board received a fax on November 20, 2000 from Attorney Jeremy Carter on behalf �I <br /> of the Petitioner requesting a continuance of the hearing. <br /> Mr. Regan moved to continue the hearing until December 13, 2000. Mr. Nelson <br /> seconded. All agreed. <br /> OTHER BUSINESS <br /> A Petition was filed on October 29, 1999 by Howard Glaser of Sharon, Massachusetts <br /> for a Variance from Sections 174-85 and 174-86 of the Zoning By-laws for permission ,I <br /> to vary the setback requirements from the ACEC to allow for construction of a <br /> single-family dwelling on properties located in an R-3 zoning district at 403 and 397 <br /> Great Oak Road(Map 126 Blocks 48 &49) Mashpee, MA.
