MA 02649 <br /> DECISION <br /> RE: Petition of Stuart Bornstein for a Variance Case #V-87-05-043 <br /> A Petition was filed by Stuart Bornstein of Mashpee, Massachusetts <br /> for a Variance for permission to vary the lot frontage requirements in <br /> a R-3 Zoning District on property located on Lot 30 Deerfield Road, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the town of Mashpee on <br /> April 29 & May 6, 1987, a copy of which is attached hereto and made a <br /> part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, May 13 , 1987 at 7 :30 p.m. at which time the following mem- <br /> bers of the Board of Appeals were present and acting throughout : William <br /> Hanrahan, Michael Makunas and Thomas Sexton. <br /> The Board established the Applicant did not re-define the boundries <br /> of the adjoining lots and the lot in question as provided for in the <br /> ammended Zoning By-Laws (section 5.53) of February 1985 and therefore <br /> created his own hardship. Opposition was voiced by abutters present. <br /> The Board reached the following "Finding of Facts" <br /> 1 . The Board ascertained the Applicant created his own hardship. <br /> 2. Abutters present voiced opposiiton to this requested Variance <br /> 3. Granting of this Variance was found to be detrimental to the <br /> neighborhood. <br />
