Jackson, Jr. SP-00-191 92 Orchard Road <br /> Map 69 Block 16 <br /> i <br /> A Petition was filed on September 27, 2000 by Franklyn B. and Audrey M. <br /> Jackson, Jr. of Burlington, Massachusetts for a Special Permit under Section 174-20 <br /> of the Zoning By-laws for permission to demolish an existing dwelling and construct a <br /> I <br /> single-family home on property located in an R-5 zoning district at 92 Orchard Road <br /> I , <br /> (Map 69 Block 16) Mashpee, MA. <br /> i I it <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I, <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, l'l <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and I I! <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on ij I <br /> i ( I <br /> Wednesday, November 22, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Marshall A. Brem. <br /> I . , <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. Ijl <br /> Mr. Paul Silva, builder for the project, represented the Petition. Mrs. Jackson also l ill <br /> attended the meeting. Mr. Silva stated that Mr. and Mrs. Jackson have owned the cottage Ij <br /> I• <br /> on the subject property since 1960. Plans call for demolition of the existing cottage and <br /> construction of a new single-family dwelling. <br /> No comments were received from abutters. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General I' j <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing. <br /> non-conforming use. <br /> Illi i II'I <br />
