Viglas V-00-195 71 Frog Pond Close jl <br /> Map 90 Block 51 i! <br /> A Petition was filed on October 6, 2000 by Charles J. and Jean D.Viglas of <br /> Winchester, Massachusetts for a Variance from Section 174-25.I.9 of the Zoning l 'I <br /> By-laws for permission to exceed the dock length limit to allow for construction of a <br /> pier, ramp and float on Popponesset Bay on property located in an R-3 zoning district <br /> i <br /> at 71 Frog Pond Close (Map 90 Block 51)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, I j <br /> I <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 22, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson,Frederick R. <br /> Borgeson and Marshall A. Brem. Mr. Regan stepped down and left the room. - <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> I <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of j <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Borselli of Holmes &McGrath, Inc. represented the Petition and <br /> stated that the owner was given permission under Chapter 91 from the Conservation I j <br /> Commission and the DEP for construction of a pier, ramp and float in the early 1990's. <br /> However, the project was not built in compliance with the plan or the license. Mr. <br /> Borselli said that the Petitioner discovered the mistake and now wishes to gain approval 1 <br /> for the project after construction. <br /> i <br /> No comments were received from abutters. <br /> i <br />
