I ' <br /> No comments were received from abutters. <br /> The Board voted unanimously to continue the Petition until December 13, 2000 to <br /> allow the Petitioner an opportunity to submit certified, engineering plans. <br /> At the continued hearings on December 13, 2000, Ms. Maribeth Hersey and Ms. <br /> Celine Ritzo represented the Petition and submitted engineered plans. <br /> VARIANCE CRITERIA <br /> i <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 16 Candlewood Lane and consists of <br /> 14,922 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. that the subject property fronts on two streets;therefore, relief may be granted <br /> without derogating from the intent or purpose of the By-laws. <br /> 2. the proposed location of the greenhouse is necessitated by the septic system <br /> and there is no other available spot on the property for its construction; <br /> therefore, a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> I I'I <br /> made and seconded, the Zoning Board of Appeals voted unanimously on December 13, j <br /> 2000 to grant a Variance of 24.2 feet from the front setback requirements. The Variance <br /> is conditioned upon compliance with Yankee Survey Consultants plan entitled"Plot Plan <br /> for Board of Appeals, Located at 16 Candlewood Lane, Mashpee, MA., Prepared for <br /> Celine Ritzo, 12/12/00, 7#52597". <br /> ! ! <br />
