Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and p <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> r <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 22, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Zella E. <br /> Elizenberry and Frederick R. Borgeson. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> i <br /> stated that it is a joint filing between Shirley Silver and New Seabury Properties, LLC. <br /> The request for a 47-foot Variance from the By-laws to allow for construction of the long <br /> walkway is required because of the location of the marsh. The Conservation Commission <br /> has approved the proposal. <br />
