Road, and informed the Town of Mashpee that all mail should be sent to <br /> 12 Fieldstone Path, Walpole, Massachusetts. <br /> 21. The Town of Mashpee negligently did not change Plaintiff's mailing <br /> I <br /> address to 12 Fieldstone Path, Walpole, Massachusetts. <br /> 22. The Town of Mashpee instead on November 13, 2000 certified to the <br /> Board of Appeals that Plaintiff's mailing address was 16 Elliot Road, <br /> Mashpee, while knowing all other abutters notified of the December 13, <br /> 2000 hearing were notified at a primary residence or at a Post Office Box <br /> in Mashpee. <br /> 23. The Town of Mashpee certified Petitioner Kenneth Hatcher's mailing <br /> address as P.O. Box 433 Mashpee and not 20 Elliot Road,Mashpee his <br /> permanent residence. <br /> 24. Plaintiff recognizes that the Defendant Members of the Board of Appeals <br /> are allowed and in most situations required to rely on the certified list of <br /> abutters provided to said Board of Appeals for notice purposes,but the <br /> failure of the Town of Mashpee to recognize the lack of delivery of mail to <br /> Elliot Road, the large amount of returned mail when sent to Mashpee <br /> addresses to which the Post Office does not deliver mail, including 16 <br /> Elliot Road, and the negligent failure to send Plaintiff's notice to 12 <br /> Fieldstone Path, Walpole, Massachusetts after informed by Plaintiff to <br /> send all mail to said Walpole address amounted to a defect in notice,to <br /> wit a jurisdictional defect(herein timely raised within ninety(90) days of <br /> the date the Board's decision was filed with the Town Clerk of Mashpee <br />
