Lyons SP-00-214 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS P¢ <br /> 1. that the subject lot is located at 122 Whippoorwill Circle and consists of <br /> 15,520 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the petitioner met the criteria necessary and the Board has granted a Variance <br /> from the setback requirements to water and wetlands to allow for the proposal. <br /> 2. the proposal would not exceed the allowed 20% lot coverage; therefore,the <br /> addition shall not be substantially more detrimental to the neighborhood than <br /> the existing non-conforming use. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on December <br /> 13, 2000 to grant a Special Permit. The Special Permit is conditioned upon compliance <br /> with the following: <br /> 1. plans of Cape & Islands Engineering entitled"Site Plan Located in <br /> Mashpee—Mass.
