• a C h� Mashpee Zoning Wags Road Realty Trust V-00-216 3 Board of Appeals In view of the foregoing,the Mashpee Zoning Board of Appeals found that the Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly made and seconded,the Zoning Board of Appeals voted unanimously on January 10, r 2001 to grant the following: ..r; 1. a Variance of 115 feet from the proposed canopy to Falmouth Road. 1. a Variance of 49.2 feet from the proposed building to Falmouth Road. 2. a Variance of 24.1 feet from the proposed building to Wags Road. 3. a Variance of 418 feet from the frontage requirements. The Variance is conditioned upon the following: ¢ 1. that the subject property shall be used for the retail sale of gasoline, oil and sale of automotive accessories. 2. that services provided shall include automotive services,towing services and automobile inspections, excluding automotive bodywork. 3. cigarettes and soda are not to be sold on the subject property in units larger than the smallest unit sold at a retail store. E 4. the offer for sale or rent of automobiles, boats or machines shall not be allowed on the subject property. 5. compliance with all Design Review Committee recommendations and requirements. 6. that the lighting at the two entrance/exit ways shall be raised in height, increased in wattage and moved closer to the property line to provide better visibility for public safety. 7. that the east driveway shall be modified to allow for perpendicular entrance/egress to Route 28,provided that the reconfiguration receives approval from the Massachusetts Highway Department. 8. that there shall be a total number of 19 parking spaces. 9. that the Petitioner shall post a Landscape Performance Security of$15,000. 10. compliance with RAM Environmental plan entitled"Johnny's Tune and Lube, 723 Falmouth Rd(Rte. 28),Mashpee,MA.,Proposed Site Plan with Existing Conditions Overlay,Date: 08/21/00,Revisions 11/15/00". 11. compliance with Hal Choubah,P.E.plan entitled"The Mashpee Station, 723 Falmouth Road,Mashpee,Massachusetts,Prepared for Hatem Enterprises, .
