,�,TU11ry Town of Mashpee <br /> � 9 <br /> ' MASHPEE ZONING BOARD OF APPEALS 16 Great Xeck PQoad Xorth <br /> Masi <br /> -tpee,Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Calico Real Estate Limited Partnership SP-00-220 81 Nick Trail <br /> Map 117 Block 99 <br /> A Petition was filed on November 6,2000 by Calico Real Estate Limited <br /> Partnership of Holliston, Massachusetts for a Special Permit under Section 174-20 <br /> of the Zoning By-laws for permission to demolish an existing cottage and construct a <br /> single-family home on property located in an R-3 zoning district at 81 Nick Trail <br /> (Map 117 Block 99)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 24 and <br /> December 1, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 13, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G.Nelson,Richard T. <br /> Guerrera and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> 'rs <br /> Mr. David Sanicki of Cape &Islands Engineering represented the Petition and <br /> stated that the proposal calls for demolition of the existing structure and construction of a <br /> new home within the same footprint. The Conservation Commission has approved the <br /> project. The Board of Health has approved the removal of two existing cesspools within <br /> 20 feet of a dune and installation of a new Title V septic system on the subject property. <br /> Building Commissioner William F. Hauck challenged the Petitioner's proposed ? ' <br /> construction of a deck across the whole front of the house as a means of egress. He said <br /> that a 4x6-foot platform would be considered a reasonable means of egress and that <br /> construction of a deck would require a Variance from the front, side and rear setback <br /> requirements. <br /> Mr.Nelson made note of the fact that the plans do not reflect what is actually ' <br /> proposed. <br /> No comments were received from abutters. <br /> The Board voted unanimously to continue the Petition until January 24, 2001 to <br /> allow the Petitioner an opportunity to submit revised plans. <br />
