<' <br /> Town of Mashpee <br /> 16 Great Aeck PQoad Sorth <br /> ZONING BOARD OF APPEALS Washpee,Massachusetts 02649 <br /> a Y ,. <br /> Decision for asix-month Extension ;._ -• <br /> RE: Donald B. &Evelyn McIntyre V-99-106 190 Waterway <br /> Map 111 Block 95 <br /> A Petition was filed on October 12, 1999 by Donald B. &Evelyn McIntyre <br /> of Wellesley Hills, Massachusetts for a Variance from Section 174-33 of the Zoning <br /> By-laws for permission to vary the setback requirements from the water and wetlands <br /> to allow for construction of a single-family dwelling with a breezeway and an '' <br /> attached garage on property located in an R-3 zoning district at 190 Waterway i��I <br /> (Map 111 Block 95)Mashpee, MA. { <br /> At the Public Hearings on December 8, 1999,the Board voted unanimously to <br /> grant the Variance. <br /> The Board received a letter from Cape & Islands Engineering on behalf of the <br /> Petitioner requesting an extension of the above-referenced Variance, V-99-106, citing <br /> that delay in starting the project is due to lack of funding. <br /> At the Public Hearings on December 13, 2000,the Zoning Board of Appeals <br /> voted unanimously to grant the extension for a period of six months. This was allowed in <br /> compliance with Massachusetts General Laws Chapter 40A, Section 10, which reads: "If <br /> the rights authorized by a variance are not exercised within one year of the date of grant <br /> of such variance such rights shall lapse;provided,however,that the permit granting <br /> authority in its discretion and upon written application by the grantee of such rights may <br /> extend the time for exercise of such rights for a period not to exceed six months; and <br /> provided, further,that the application for such extension is filed with such permit <br /> granting authority prior to the expiration of such one year period". <br /> !e�LK- � , . <br /> IN FAVOR: <br /> Robert G.
