,tz <br /> : Town of Mashpee <br /> 16 great J�eck load Xorth <br /> Utz Mashpee, Massachusetts 02649 1 <br /> MASHPEE ZONING BOARD OF APPEALS =1 " <br /> Decision for Extension of a Variance <br /> RE: Howard Glaser V-99-114 403 & 397 Great Oak Road <br /> Map 126 Blocks 48 &49 <br /> A Petition was filed on October 29, 1999 by Howard Glaser of Sharon, <br /> Massachusetts for a Variance from Sections 174-85 and 174-86 of the Zoning <br /> By-laws for permission to vary the setback requirements from the ACEC to allow <br /> for construction of a single-family dwelling on properties located in an R-3 zoning <br /> district at 403 and 397 Great Oak Road(Map 126 Blocks 48 &49) Mashpee, MA. <br /> (Owner: New Seabury Properties LLC.) <br /> The Zoning Board of Appeals voted unanimously on December 8, 1999 to grant <br /> the request for a Variance,V-99-114. <br /> On November 9, 2000,the Board received a fax from Howard Glaser requesting <br /> an extension of the above-referenced Variance. Mr. Glaser stated that the need for an <br /> extension is due to delays in funding and hiring of subcontractors. <br /> At the Public Hearings on November 22, 2000,the Zoning Board of Appeals <br /> voted unanimously to grant the extension of the Variance,V-99-114, for a period of six <br /> months. This was allowed in compliance with Massachusetts General Laws Chapter <br /> 40A, Section 10, which reads "If the rights authorized by a variance are not exercised <br /> within one year of the date of grant of such variance such rights shall lapse; provided, <br /> however,that the permit granting authority in its discretion and upon written application <br /> by the grantee of such rights may extend the time for exercise of such rights for a period <br /> not to exceed six months; and provided, further,that the application for such extension is <br /> filed with such permit granting authority prior to the expiration of such one year period". <br /> IN FAVOR: �ti-- <br /> James E.
