Stolba of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws to vary the <br /> front setback requirements to allow for construction of a single-family home on property li <br /> located in an R-3 zoning district at 37 Cappawack Road(Map 72 Block 35)Mashpee, <br /> MA. <br /> Notice was d <br /> I <br /> ul <br /> y given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on March 23 and March 30, <br /> 2001, a copy of which is attached hereto and made a part hereof. <br /> i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 11, 2001, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James E. Regan III, Frederick R. Borgeson <br /> and Marshall A. Brem. I l <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> I I i <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki represented the Petition and stated that the request is for the <br /> I <br /> same Variance relief previously granted by the Board that has now lapsed. The original <br /> i <br /> Proposal was to locate the house further back from the street. The Conservation <br /> I� <br /> Commission demanded a 50-foot buffer from the water and wetlands,making it <br /> necessary for the Petitioner to seek Variance reliefrequirements. II <br /> from the front setback <br /> I <br /> The Conservation Commission has issued an Order of Conditions on the project. <br /> No comments were received from abutters. <br /> i <br />
