Mashpee Zoning Minutes—May 9, 2001 <br /> Board of Appeals 10 <br /> j <br /> Mr. Regan asked if Mr.Eynation would be agreeable to try to resolve the issue. Mr. <br /> Eynation said that he would sit down with the Petitioner and discuss terms under which <br /> he would not object to the proposal. � ! <br /> Ms.Elizenberry questioned Mr.Eynation if he had attempted to contact the Petitioner l <br /> before the Public Hearings. Mr. Eynation replied that he had not and that the burden is <br /> upon the Petitioner to contact neighbors when seeking Variance relief. Ms.Elizenberry <br /> asked Mr. Eynation: "So, you're taking a public forum to talk to your neighbor?". Mr. <br /> Regan said that he appreciated Mr. Eynation's opinion. Ms.Elizenberry said that she <br /> also understood that, but objected to the Board being asked to be the mediator between <br /> the two neighbors. <br /> Mr. Govoni offered to set up a meeting with Mr.Eynation and the Petitioner for <br /> Saturday, May 12'. Mr. Eynation said that he would not be on the Cape until May 25a'. � <br /> Mr. Govoni asked Mr.Eynation for what he wanted and said that the Petitioner wants to <br /> be a good neighbor. <br /> it <br /> Mr.Eynation looked at the plans and asked why the deck could not be constructed on the <br /> front of the house. Mr. Govoni said that the Building Department asked for the Petitioner <br /> to maintain the setback from the street. <br /> I � <br /> Mr.Eynation said that he has a privacy screen on his deck and that he did not want to see <br /> his neighbor. Mr. Govoni asked if Mr. Eynation would be amenable to installation of a <br /> privacy screen on the Petitioner's deck. Mr.Eynation said that it would depend on the <br /> height of the privacy screen since the Petitioner's elevation is much lower than his <br /> elevation. He claimed that there would still be visibility from his deck to the Petitioner's <br /> deck. Mr. Eynation and Mr. Govoni went into a lengthy discussion concerning the <br /> details and location of aprivacy screen and shrubbery. <br /> I <br /> Mr. Govoni informed Mr. Eynation that plantings could not be installed on the easement <br /> because the roots would interfere with the pipe that runs throughthe easement. <br /> Mr. <br /> I <br /> Eynation disagreed with <br /> Mr. <br /> Govoni and said thatIII ' <br /> construction cannot be done on the � <br /> easement but that plantings can be installed there. Mr. Govoni tried to explain that the <br /> easement should be kept clear for easy access. � <br /> Mr.Regan asked Mr.Eynation what kind of landscaping would be acceptable. Mr. <br /> Eynation ons <br /> said that arborvitae or something similar would <br /> be fine. Mr. Guerrera said that <br /> Mr.Eynation's privacy screen protected him from his neighbors seeing him and said that <br /> if Mr. Eynation did"not look at them,then you're not violating their privacy". Mr. f <br /> Regan admitted that the lots have a sloping topography. <br /> Mr.Borgeson asked for clarification of the location of Mr.Eynation's existing privacy <br /> 'i <br /> screen. Mr. Eynation said that the only place that he has not installed a privacy screen on <br /> his deck is where he has an egress with a brick patio where he does his barbecuing. <br />
