Mashpee Zoning 2 <br /> Board of Appeals <br /> Terrance V. & Sandra A. McNeil V-01-67 <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 30 Jackbon Road and consists of 7,5000 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. there are circumstances (such as the abutting open space subdivision and road) <br /> relating to the shape and topography that affect the subject lot and not the <br /> district in which it is located. <br /> 2. the proposed addition of the garage would only encroach 2 %2 feet into the <br /> required sideline setback requirements,therefore, relief may be granted <br /> without substantially derogating from the intent or purpose of the By-laws. <br /> 3. the only place on the lot where addition of a garage could be constructed <br /> where it would not encroach on the setback requirements would be in the rear <br /> of the lot, making it impracticable;therefore, a literal enforcement of the <br /> By-laws would involve hardship to the Petitioner. <br /> 4. the lot pre-dates zoning. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that <br /> the Petitioner met the criteria necessary for the granting of a Variance. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on May 9, <br /> 2001 to grant a Variance of 2 %2 feet from the sideline setback requirements and a <br /> Variance of 2% from the lot coverage requirements to allow for construction of a deck, <br /> porch and garage on the subject property. The Variance is conditioned upon compliance <br /> with Cape&Islands Engineering plan entitled"Plot Plan of Land Located in Mashpee, fi <br /> Mass.,Prepared for Terrance McNeil,Date: Mar. 14, 2000". <br /> t <br />
