V-01-61 36 Topping Lift l <br /> Map 125 Block 216 <br /> A Petition was filed on April 26, 2001 by Chilton Development Company, Inc. <br /> of Marshfield, Massachusetts for a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the rear setback requirements to allow for construction <br /> of a pool and cabana on property located in an R-3 zoning district at 36 Topping Lift <br /> (Map 125 Block 216)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 4 and May 11, <br /> 2001, a copy of which is attached hereto and made a part hereof. ' <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 23, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of M <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petitioner requested <br /> Withdrawal Without Prejudice of the above-referenced Petition. <br /> The Board voted unanimously to accept the Request for Withdrawal Without ar <br /> Prejudice of the Petitioner for a Variance,V-01-61. <br />
