<br /> a newspaper of general circulation in the Town of Mashpee, on August 3 and August 10,
<br /> 2001, a copy of which is attached hereto and made a part hereof.

<br /> These Petitions have been continued from the August 22 and September 19, 2001
<br /> Public Hearings. At the continued Public Hearings on October 10, 2001, the following
<br /> members of the Zoning Board of Appeals were present and acting throughout: Edward
<br /> M. Govoni, Robert G. Nelson and Zella E. Elizenberrr .

<br /> The Mashpee Zoning Board of Appeals issues this determination pursuant to the
<br /> provisions of Massachusetts General Laws Chapter 40A Sections 8 and 10 and the Town
<br /> of Mashpee Zoning By-laws. II
<br /> Attorney Robert F. Mills, Legal Consultant Donna Bergamo and Willowbend
<br /> Vice President John E. McElhinny represented the Petition. Also present was the Town
<br /> of Mashpee Building Commissioner being an interested party. Attorney Mills briefly
<br /> went through the history of the Petition and stated that at the Public Hearings held on July
<br /> 22, 1998, the Zoning Board of Appeals voted unanimously to grant the Petitioner j
<br /> permission to vary the lot size requirements on 35 lots in Shoestring Bay Estates,
<br /> Variances V-98-33 through V-98-67.
<br /> Because of restrictions imposed by the Growth Management By-law, the
<br /> Petitioner is unable to develop all of the subject lots in any one year. On July 7, 1999,
<br /> the Board received a request from the Petitioner for an extension on the above-referenced
<br /> Variances. At the Public Hearings held on July 14, 1999, the Zoning Board of Appeals
<br /> voted unanimously to a grant six-month extension on the Variances. On January 12,
<br /> 2000, the Petitioner filed a new application for Variances on 25 of the subject lots. At the
<br /> Public Hearings held on February 9, 2000,the Zoning Board of Appeals voted
<br /> unanimously to grant the Petitioner permission to vary the lot size requirements on 25 of j
<br /> the original 35 lots. On January 5, 2001, the Petitioner applied for an extension of the
