Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 3 and August 10, <br /> 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petitions at the Mashpee Town Hall on <br /> Wednesday, August 22, 2001, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson <br /> and Richard T. Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws aws s Chap ter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Donna Bergamo represented Willowbend Development <br /> Corporation and i <br /> submitted a map of the subject property. She said that the Petitioner purchased the <br /> property in October 1998 and development and sale of the lots commenced in 1999. <br /> Roads, utilities and sewer connections for the lots have been installed at a cost of <br /> approximately $2,000,000. <br /> Attorney Bergamo stated that 20 of the original 35 Variances granted by the <br /> Board in 2000 have lapsed. <br /> The Board said that it would prefer to wait before rendering a decision until after ' <br /> the Petitioner's upcoming Cape Cod Commission hearing on August 23, 2001 concerning <br /> a proposed golf course expansion that would impact four of the twenty lots. <br /> Attorney Bergamo expressed concern that no one would purchase a lot needing <br /> Variance relief without a recorded decision granting such relief. The problem lies in the <br /> fact that the Petitioner is severely restricted from developing by the Town's Growth <br /> Management policy. That policy limits issuance of seven Building permits per year to <br /> this Petitioner. <br /> No comments were received from abutters. <br />
