Mashpee Zoning Jonathan H. Leach, VMD V-01-73 2 <br /> Board of Appeals <br /> The subject property consists of 1.02 acres of land in a C-2 zoning district with <br /> frontage on Main Street. The proposed building would be a single-story frame structure <br /> and approximately 3,888 square feet in size. All activity will be conducted indoors on a <br /> scheduled appointment basis. No boarding of animals is proposed. Traffic generated by j <br /> the establishment would be minimal. The proposal meets the parking requirements. <br /> The project has <br /> been designed ned a <br /> ccordin to the requirements of the Groundwater <br /> Protection District. Because the bodies of any dead animals will be disposed of outside <br /> the Town of Mashpee by a special contractor, the proposal will not involve the use of <br /> hazardous waste. <br /> The proposal is an allowed use within a - <br /> C 2 zoning district with P p th ant of a Special <br /> g �' <br /> P <br /> Permit by the Zoning Board of Appeals. The Board has granted the Petitioner a Special <br /> Permit to allow for the proposal on the subject property. <br /> Attorney Mullin addressed the requests for Variance relief from Section 174-31 of <br /> the Zoning By-laws concerning frontage and setback requirements. Because of the shape <br /> of the property, it lacks the required frontage of 200 feet on Main Street. The topography m, <br /> of the property presents a hardship because of a kettlehole on one side of Oakwood Road <br /> that drops approximately 30 feet over an 80-foot distance. <br /> Attorney Mullin also stated that Oakwood Road is a paper road and will probably <br /> never be constructed due to the kettlehole. However, Section 174-31 requires a 75-foot <br /> setback from Oakwood Road. If the proposed construction were to conform to this <br /> setback requirement,ment <br /> the width of the building would have to be reduced to 14 feet <br /> q g , <br /> making the <br /> project an impossibility. <br /> II <br /> Mr. Maroner <br /> discussed the proposed landscaping of the subject property. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 482 Main Street and consists of 1.02 <br /> acres of land. <br /> H <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br />
