Taylor of Norwell, <br /> Massachusetts for a Variance from Sections 174-31 and 174-33 of the Zoning -laws B <br /> Mass Y <br /> to modify the side, front and lot coverage requirements and the setback requirements to l <br /> water and wetlands to allow for construction of a single-family home on property located <br /> in an R-3 zoning district-at 112 Waterway,(Map 105 Parcel 219)Mashpee, MA. LII j <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 24 and August <br /> 31, 2001, a copy of which is attached hereto and made a part hereof. <br /> The September 12, 2001 Public Hearings were canceled due to the national <br /> tragedy that occurred on September 11, 2001. A Public Hearing was held on the Petition <br /> at the Mashpee Town Hall on Wednesday, September 19, 2001, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> submitted pictures of the existing dwelling on the subject property and a copy of the <br /> proposed extensive landscaping plan. Plans call for demolition of the existing dwelling <br /> to be replaced with construction of a new home that would be located approximately 38 <br /> feet from the top of the coastal bank. The Petitioner is requesting Variance relief from <br /> the lot coverage requirements, front and side setback requirements and setback <br /> requirements to water and wetlands to allow for the proposal. There is no planned Ill <br /> increase in bedrooms. <br /> I, II. III I <br /> The Board of Health has approved installation of a new septic system. The l j <br /> Conservation Commission has also approved the project. The Zoning Board of Appeals <br /> has granted the Petitioner a Special Permit to allow for demolition of the existing <br /> dwelling. III; <br /> ISI <br /> No comments were received from abutters.
