Mashpee Zoning Minutes— September 12, 2001 g <br /> Board of Appeals <br /> Mr. Govoni moved to take the Petitions under advisement until October 24, 2001. Mr. <br /> Nelson seconded. All agreed. <br /> OTHER BUSINESS <br /> Chad Cutler asked the <br /> Mr. Board for permission ssion to address the issue of zoning n on <br /> g <br /> Monomoscoy Island. He submitted copies of recent ZBA decisions in the area with a j <br /> paragraph ending with the following: <br /> "Some of these variances were minor, and perfectly reasonable, particularly the <br /> ones requesting additions to existing buildings. But the open lot variances could <br /> hardly be called candidates for"hardship", as they were being built for new �! <br /> owners who knew that the lots weren't buildable without variances. Indeed, one <br /> of them is being advertised for sale at $1,600,000! Where is the hardship here? <br /> i <br /> These variances threaten our waterway and marshes, and disrupt the symmetry of <br /> our neighborhood". <br /> Mr. Cutler expressed concern with the size, shape and location of recent construction on (!; <br /> Monomoscoy Island. <br /> I' <br /> Mr. Govoni told Mr. Cutler that current zoning by-laws do not apply to any lot created I' <br /> before 1959 that consists of a minimum of 5,000 square feet and that has been in single j <br /> ownership. Mr. Govoni suggested that Mr. Cutler refer to Chapter 40A. <br /> Mr. Govoni said that the Board works closely with the Conservation Commission. The <br /> ZBA will consider granting variances if the Conservation Commission approves the <br /> proposal. The Board is very concerned with cesspools that drain into the river and will <br /> consider granting variances on new constructions that includes installation of new <br /> denitrification septic systems that will lower the amount of nitrates. <br /> Mr. Govoni said that anyone aggrieved by a Decision of the Building Commissioner or <br /> the ZBA has the right to appeal the decision in a court of law. <br /> g pp � <br /> Mr. Cutler claimed that four empty lots on Monomoscoy Island that are "underwater" are <br /> now considered "buildable. He said that the Board should consider not granting so many �!!I <br /> variances. Mr. Govoni said that the Board will carefully look into any Petitions coming <br /> up. Mr. Govoni repeated what he said earlier - that if the lots are at least 5,000 square <br /> feet and were created before 1959 and have been in single ownership, the lots are <br /> "buildable". <br /> Mr. B <br /> orgeson said that he has spent a lot of time going throughout Monomoscoy Island. <br /> He asked Mr. Cutler what was really bothering him—all the current construction <br /> underway or the huge home being built on the causeway? Mr. Borgeson wondered what I ' <br /> was suddenly causing all the upset on the Island.
