Mashpee Zoning Minutes—September 12, 2001 4 <br /> Board of Appeals <br /> V-01-84-19 Lot 34: 55 Shoestring Bay Road (Map 84 Parcel 29)—31,318 square feet. <br /> Variance relief requested: 8,682 square feet. <br /> V-01-84-20 Lot 35: 61 Shoestring Bay Road (Map 84 Parcel 35)—25,690 square feet. �! <br /> Variance relief requested: 14,3 10 square feet. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> Attorney Robert M. Mills and Ms. Donna Bergamo represented the Petition. Attorney <br /> Mills stated that four of the subject lots are currently under Purchase and Sale ! <br /> Agreements and he requested Variance relief on Lots 9, 25, 30 and 34. <br /> Mr. Govoni said that Willowbend made a mistake by coming to the ZBA with 30 <br /> different Variances and should have come in as a subdivision development. Ms. <br /> Bergamo said that Willowbend was told to submit the Petition as 30 separate lots. <br /> Attorney Mills asked the Board to continue the remaining lots on the Petition and said <br /> i <br /> that he would be able to.demonstrate that Willowbend has exercised its rights through the <br /> t <br /> Variances and that no further Variances are required. Attorney Mills stated that the <br /> Massachusetts Zoning Manual "strongly suggests that the exercise of right under a <br /> Variance is as little as pulling a building permit". He said that Willowbend has <br /> performed substantial work of the project as a whole and has spent in excess of <br /> $2,000,000 in developing the subject neighborhoods. <br /> No comments were received from abutters. <br /> Mr. Nelson moved torant Variance relief lief of the following I <br /> • 17,537 square feet on Lot 9, 68 Shoestring Bay Road <br /> • 11,4_38 square feet 2 <br /> q on Lot ..5, 1 Mute Swan Circle. <br /> - <br /> • 6,080 square feet on Lot 30, 33 Shoestring Bay Road. <br /> • 8,682 square feet on Lot 34, 55 Shoestring Bay Road. <br /> Mr. Govoni i! <br /> seconded.
